Hi guys. I put an application for a one bedroom apartment and I paid a deposit with my application which was worth one month's rent. Due to unexpected circumstances (my parent had a stroke) I cannot move in and I would like to cancel the application. If I cancel the application will I receive the deposit back?

I guess it's between you and your landlord, but if there's not much notice, then I wouldn't expect it back.

Hey, sorry to hear about your parent. Anyway, if it's short notice, I wouldn't expect the money back. However, it really depends on the landlord. Some of them are nice enough to give it back... others won't. You could explain the situation to the landlord because it's not like you all of a sudden found a better place. Good luck.

Is there any laws in Ontario that state what happens to the deposit if you decide not to move in?

Don't know the answer but you entered into a binding agreement and better to lose the deposit than to have started living there and trying to cancel afterwards. If the landlord can rent the apt quickly and not lose any rental (i.e., someone else will move in for same rental in same timeframe you were supposed to), he may be sympathetic; otherwise, expect to lose the deposit as this is a business transaction.

Do a search on the landlord and tenant act of ontario...if you can't find the info you need, they usually have a phone number that you can call for advice.

None that I have heard of. I could be wrong however.
